The Judicial Services Commission is investigating the acting Maligakanda magistrate on a charge of professional misconduct.

Himali Ekanayake faces accusations from the aggrieved party in a court case relating to overcharging by a leading private hospital in Colombo.

The Medicines Regulatory Authority has filed the case on 11 counts, which chief magistrate Lochani Abeywickrama had fixed for hearing on 23 January.

On a motion filed by the hospital’s lawyer, Ekanayake took it up five days earlier in the absence of the NMRA and the aggrieved party.

She closed the case after imposing a Rs. 25,000 fine on the hospital which pleaded guilty to the charges.

The complaint said both the acting magistrate and the lawyer who represented the hospital are members of the same legal team.
