SLPP MP Premnath C. Dolawatte has said that parliament is empowered to act in instances of violation of its powers and privileges as per 4(c) of the constitution.
Addressing the House yesterday (07), the lawyer MP raised a point of privilege arising from the injunction SC (FC) no. 69/2023 issued on March 03.
Quoting from the constitution, Dolawatte explained in detail that parliament has financial control of the state.
An injunction issued by a SC judges panel attempts to nullify the non-violable powers vested in parliament and in breach of a principle of natural justice, he claimed.
The matter of the local government election is an affair of parliament with a proposal already in the agenda to form a select committee, and the judges have disregarded that despite it being noted by the attorney general, the SLPP MP claimed.
Also, the disregard for an affidavit submitted by the finance secretary about a lack of funding is a violation of traditions that leads to anarchy of the judiciary, according to him.
A member of the judges panel has a connection with a petitioner with regard to the same matter, which he has failed to declare and he has not withdrawn from the petition’s hearing either, he added.
